In today’s episode, we are going to discuss what you should be aware of when looking to assign a new development project before completion or taking ownership.
The first important information to remember is that an assignment sale is a contract between three parties, the developer, the assignor, who initially put down the deposit for the unit, and the assignee, who is now interested in taking over the unit. At the end of the day, the developer has the right to refuse and sell in the assignment, so make sure both parties understand that before entering into the transaction.
Another important thing to remember is that the assignee does take on additional financial risk and liability once they take over the contract. They are now going to have to pay the developer the remainder of the money for the unit once it completes but also run the risk of the developer not completing the construction or going bankrupt.
